Privacy Policy

Thomas Townsend and Kent (TTK) owns and operates a variety of different web sites, e-mail newsletters and their respective subscriber lists, and other properties where consumers transact and may disclose information to us. These properties include but are not limited to: Art Travel Guide, Luxury Cruise News, Your Travel Insider, Home Journal and HealthGuides2008. TTK understands that in your interaction with us you may have concerns about safeguarding your privacy online. The Privacy Policy that follows explains our views and practices concerning the privacy and transmission of data acquired by TTK and how these policies may pertain to consumers. Please consider these factors as you make a choice to interact with our Web sites, e-newsletters and offer from our partners. This statement discloses the data privacy practices for all Web sites, e-newsletters and e-mails currently and formerly operated by TTK which are pertinent to all consumer data that TTK retains as a result of its current and past data acquisition operations.

Collection of Personal Information from Site Visitors

The following information is automatically collected and/or tracked, if possible, from visitors to TTK owned and operated Web sites: (1) The home server domain names, IP address, e-mail addresses, type of computer, and selected Web browser (2) E-mail address and other personal data that consumers provide when interacting with an e-mail communication or Web site (3) Personal, financial, behavioral, demographic and other information gathered though the use of online registration forms, surveys, e-mail interactions, contests, sweepstakes and technology-based tools (4) Information, aggregate or user specific, on visitor interaction with our web pages and e-mails including activity on links included within these Web sites and e-mails. Some of this data may be collected and stored on systems not owned by TTK, but only TTK and its employees have access to using this information for marketing efforts.

Use of Personal Data Collected

Personal data collected, as stated above, may be used by TTK for any or all of the following purposes: Editorial feedback; Marketing and promotions for TTK or its clients, partners or associates; Statistical analysis of user behavior; Product development and content improvement; To inform advertisers of how many consumers viewed and/or clicked an advertisement and other services' for our advertisers; To customize content and layout of TTK-operated Web sites; and to create, relay and/or direct advertising messages. Customer contact information (including but not limited to names, e-mail addresses and postal information) and all other data collected, may be added to TTK's databases and used for future promotional campaigns and e-mail communication regarding: Site updates; New and existing products and services; Upcoming events; Distribution of online publications; Distribution of advertisements for clients, partners or associates, and status updates of orders placed online. Financial information collected may be used for the following purposes: To verify a user’s qualifications for registration; billing for products and services; Notification in the event of contest or sweepstakes winnings; To verify and/or enhance existing data; and to notify the relevant taxing and regulatory authorities regarding prizes awarded.

Demographic and behavioral data collected is used to: Define the appropriate publications and offers for our users; Analyze marketing results; Personalize the visitor’s experience at our site(s); and assist TTK in development of relevant content and advertising for our users. TTK uses customer contact information to provide users information about our company, publications and to deliver promotional material on behalf of our partners. A customer’s contact information may also be used to notify him or her in the event of sweepstakes or contest winnings, and to notify the relevant taxing and regulatory authorities regarding prizes awarded.

Disclosure of Personal Data to Third Parties

Any third party to which TTK shares, rents, sells, or otherwise discloses personal data will be pre-screened by TTK based on internal criteria. Partners may be granted permission by TTK, within its sole judgment, to use the personal data for the marketing of products and services' relevant to users. TTK may disclose to third parties all or part of the information gathered from site visitors and data derived from their online behavior; data enhanced from third-party sources; and information in aggregate form. At the sole discretion of TTK, under applicable law, all data collected by TTK may also be shared with third parties for uses including but not limited to: Direct marketing of products and services', Creation of additional data products for TTK; Appending and/or enhancing the existing data, Appending of data to third party data files; Validation and data updates; The creation and use of aggregate data products; Individual reference or look-up services'; Suppression services', and for comparison and validation with other data properties not owned or controlled by TTK. TTK reserves the right to transfer the data multiple times and concurrently on both a temporary and permanent basis and for an unlimited or unspecified amount of time and for unspecified number and types of uses. By consenting to this privacy policy the visitor permanently waives all rights or restrictions on the use, transmission, storage or transfer of the data and any claim to fees, royalties or other compensation directly or indirectly as a result of TTK’s use, storage, transfer or transmission of the data by TTK, TTK’s partners, vendors, clients, associates and service companies.

Through the use of third-party cookies and other tracking methods, an advertiser may be electronically notified when visitors view or click on its advertisements. TTK’s properties often contain links to other sites and TTK is not responsible for the privacy practices or the content of such sites.

Opt-Out Right

We allow users the opportunity to opt-out of receiving commercial e-mail communications from advertisers who have rented TTK e-mail lists and/or from TTK published e-newsletters (as defined in the CAN SPAM Act of 2003) by using the opt-out method as specified in the communication. All commercial mailings from TTK contain an opt-out procedure specific to that sender or line of business. It is our policy that all advertisers, partners and affiliates fully comply with the CAN SPAM Act of 2003. TTK is not responsible for failure of third parties to fully comply with any law or regulation.

Consumer Choice - TTK Exclusion List

It is TTK's policy to allow any consumer whose information is included in the TTK database to 'opt-out' of having their information further shared with third party companies or partners and/or for any use by TTK in its data related products or operations, except for the use of that data to ensure the consumer is excluded from future uses.

Therefore, TTK maintains an exclusion list of persons who specifically have requested that their data not be further shared with third parties and/or who have requested their data not be used for future marketing purposes by TTK. A person may have their information added to the TTK Exclusion List by sending a written request with their e-mail address first and last names to traffic@ttkpub.com with a request to opt-out of future data sharing and/or marketing operations. It may take up to 30 days for all electronic marketing uses of the data to cease and 60 days for all postal marketing and other uses to cease. IT IS TTK's POLICY NOT TO SHARE OR DISEMMINATE USER DATA IN ANY WAY WITH ANY THIRD PARTY, OR USE THE DATA FOR MARKETING PURPOSES WITHOUT ALLOWING THE USER AN OPPORTUNITY TO OPT-OUT OF FUTURE USE AND COMMUNICATIONS.

Collection of Personal Data from Children

The information and services' provided at TTK’s web site, via postal mail or through e-mailings by TTK, its affiliates, sponsors, and advertisers are not intended to be viewed by children under 18 years of age. All drawings, publications and other activities offered at TTK sites or via TTK publications, postal mailings or e-mail communication are open to United States residents 18 years or older only. TTK will not knowingly permit a child or minor to participate in a contest, sweepstakes or any another activity. If a child or minor wins a drawing, that child’s entry will be voided, and another winner will be drawn. If a child’s or minor's data is discovered in a TTK database, list or other operation, then TTK will add that data to the TTK Exclusion list and no further data sharing or marketing will be done with that child or minor. It is TTK's policy to transact and communicate only with persons 18 years or older except as noted below.

Concerning visitors to our Web sites that are known to be children or minors under 18 years of age, TTK maintains the following policies: TTK will not knowingly collect personal, behavioral, financial or other information from children under 18 years of age without prior parental consent, which will include an opportunity for the parent to prevent use of the information and participation in any activity. Without prior parental consent, online information will only be used to respond directly to the child’s request and/or to exclude the child or minor from future contact and will not be used for other purposes without prior parental consent.

In the event TTK agrees to accept interactions from a child or minor and a child or minor submits information to the TTK Web site, an e-mail address for the child’s parent or guardian must be provided. Thereafter, TTK will send an e-mail to the parent or guardian alerting them to the child or minor's registration and providing instructions on how the parent can provide consent for the child or minor to view the contents of the TTK Web site or other communication, and how the parent may view or delete the child or minor's registration, if so desired.

TTK will not knowingly distribute to third parties any personally identifiable offline contact information of children or minors under 18 years of age without prior parental consent.

It is TTK’s policy that no information collected from children is to be used for any marketing or promotional purposes whatsoever by TTK.

TTK's Right to Contact Users

TTK reserves the right to contact site visitors regarding account status and changes to subscriber agreements, this privacy policy, and any other policies and agreements relevant to site visitors or members of our database.

TTK's Right to Change Privacy Policy
